Penalty Phase Underway in Boston Bombing Trial of Dzhokhar Tsarnaev The penalty phase of the Boston Marathon bombings trial got underway on Tuesday as a judge told jurors that "it is impossible for me to overstate the importance of the decision in front of you" — deciding whether Dzhokhar Tsarnaev should live or die. The government, arguing for the death penalty, was expected to make its opening statement later in the day. The defense, arguing that Tsarnaev should get life in prison without parole, will make its opening statement on Monday and begin its case. The same jury convicted Tsarnaev of all 30 federal counts resulting from the bombings on April 15, 2013, and the killing three days after of an MIT police officer.
